Diagnosis, Liability, and Warranty

Diagnosis: Service applies if the equipment is:

  • Within the home’s permanent foundation (except outdoor AC units),

  • Properly installed and operational as of Coverage Date,

  • Accessible and safe for technicians.

Liability: We aim to resolve issues on the first visit but are not liable for delays or misdiagnosis. Our responsibility is limited to correcting covered problems. We are not liable for consequential damages, pre-existing defects, or items under manufacturer warranty. All service must be performed by our authorized technicians.

Unavailable Parts/Non-repairable Equipment: If parts are unavailable or not economically feasible to replace:

  • Either party may terminate the Plan.

  • Refund of up to 12 months of payments from the last service date if applicable.

Warranty: Covered repairs are warranted for 90 days after service unless covered longer by manufacturer warranty.

Exclusions

This Plan does not cover:

  • Commercial-use equipment,

  • Pre-existing conditions,

  • Misuse, abuse, tampering, or improper installation,

  • Acts of God, fire, flood, earthquakes, weather-related damage, vandalism, or theft,

  • Damage from pests, mold, rust, corrosion, or hazardous materials (e.g., asbestos),

  • Building code violations or required upgrades,

  • Consumables (e.g., filters, fuses),

  • Cosmetic or structural repairs (e.g., walls, floors),

  • Unauthorized repairs or third-party service costs,

  • Items under manufacturer/builder warranty,

  • Preventative maintenance unless specified.

We reserve the right to exclude certain equipment models/types.

Technician Safety

We may decline service if conditions are unsafe or unsanitary, or if equipment is inaccessible. We may cancel your Plan without refund in such cases.

Governing Law

This Agreement is governed by the laws of Ontario, Canada.

Entire Agreement

This document represents the entire agreement and supersedes all prior agreements or discussions.

Conflicts

If inconsistencies arise between this document and enrollment materials, this document prevails.

Assignment

We may assign this Agreement without notice. You may not assign without our written consent.

Notice

We may contact you via phone or email. You are responsible for providing updated contact information.

Force Majeure

We are not liable for delays or failure to perform due to events beyond our control.
